§ 1. General Provisions
These Terms and Conditions govern the use of the mobile app
TapTaxi (the ‘App’) by passengers booking passenger transport, goods transport and additional services.
The App service provider and Transport Operator is the taxi company TapTaxi — Taxi Kaszuby Radosław Czerniecki (the ‘Transport Operator’). Transport services are provided by Drivers working with it.
The Technology Provider is Taxi Osowa Patryk Fanslau (brand: FTSProjekt), ul. Gospody 18A/7, 80-340 Gdańsk, NIP: 5842626895, which supplies and maintains the App and operates the TapTaxi telephone dispatch centre on behalf of the Transport Operator. The sole party to the transport contract with the Passenger is the
Transport Operator; FTSProjekt is not the Transport Operator. Taxi Osowa Patryk Fanslau may independently provide transport as one of the cooperating Drivers.
By accepting these Terms and Conditions in the App, you enter into an agreement with the Transport Operator for electronic services that let you use the App.
§ 2. Definitions
Passenger / Customer — a natural person with full legal capacity who uses the App to book a journey or additional service.
Driver — a person or business working with the Transport Operator to fulfil transport bookings through the App.
Transport Operator — the taxi company
TapTaxi, operated by Taxi Kaszuby Radosław Czerniecki (NIP: 8451824894).
Technology Provider — Taxi Osowa Patryk Fanslau (brand: FTSProjekt), which supplies and maintains the TapTaxi software and processes data solely on the Transport Operator’s instructions.
Dispatcher — a person operating the Transport Operator’s dispatch centre.
Journey — a single booking for passenger transport, goods transport or an additional service fulfilled through the App.
Scheduled Journey (reservation) — a journey booked in advance for a specified date and time.
Price List — the Transport Operator’s current rates.
§ 3. Registration and the Passenger’s Account
You need to register an account to use all App features. You can register by:
providing an email address and password, or
signing in with a Google account, or
biometric unlocking (if supported by the Passenger’s device).
The Passenger must provide accurate details, particularly their telephone number and first name.
The Passenger must protect their sign-in details and not share them with third parties. The Passenger is responsible for the actions of people using the account.
The account may be blocked for breach of these Terms and Conditions, particularly repeated false bookings, aggression towards Drivers or attempted fraud.
§ 4. Booking a Journey
The Passenger books a journey by:
entering the pick-up address (or using their GPS location),
entering the destination address,
optionally adding intermediate stops,
choosing a vehicle type (Standard, Estate, Minivan, Minibus),
choosing a service type (Taxi, Shopping, Jump-start, Parcel),
choosing additional options (child seat, pet transport, parcel),
choosing a payment method (cash / cashless),
confirming the booking.
Once a Driver accepts the booking, the Passenger receives information in the App about the Driver (first name, vehicle make and registration number) and the estimated arrival time.
The Passenger may book an immediate journey or
scheduled journey. The Transport Operator does not guarantee that a journey can be provided if no Drivers are available.
During the journey, the Passenger may contact the Driver using the App’s built-in chat or by telephone.
§ 5. Journey Price
The price displayed in the App before the journey is an
estimate and is calculated from the planned Google Maps route and the Transport Operator’s Price List.
The final journey price may differ from the estimate, particularly where:
the journey follows a different route from the one calculated by the App (e.g. at the Passenger’s request or due to diversions),
traffic disruption occurs during the journey,
the Passenger changes the destination or adds intermediate stops,
additional services not included in the booking are added.
The Driver specifies the final price after the journey in accordance with the Price List. The Passenger may request an explanation of how it was calculated or ask the Dispatcher to verify the price.
§ 6. Types of Service
Passenger transport (Taxi) — standard passenger transport, charged according to the Price List.
Shopping — purchase and delivery of goods specified by the Passenger. Flat rate (PLN 50 daytime, PLN 60 night-time).
Parcel / courier — delivery of a parcel without a passenger, charged according to transport rates.
Additional services: child seat (with the option to specify the number of seats), pet transport, parcel transport.
A booking with an additional option is fulfilled only by a Driver who has declared that they provide it.
§ 7. Price List and Payments
The price of a Taxi journey is calculated as follows:
initial charge + (distance in zone 1 × zone 1 rate)
+ (distance in zone 2 × zone 2 rate)
+ vehicle type surcharge
+ cost of additional options
Vehicle type surcharges compared with Standard: Estate +PLN 20, Minivan +PLN 40, Minibus +PLN 50.
The current Price List is available in the App and on the website www.taptaxi.pl.
Payment methods:
cash — paid directly to the Driver after the journey,
cashless — on the terms specified in the App or agreed with the Transport Operator.
The Driver provides a receipt or electronic receipt for every journey. An invoice is issued at the Passenger’s request.
§ 8. Passenger Rights and Obligations
The Passenger has the right to:
safe transport by a verified Driver,
know the estimated journey price before it begins,
contact the Driver during the journey and contact the Dispatcher,
make a complaint (§ 11),
request that the journey be ended at a safe location at any time.
The Passenger undertakes to:
provide an accurate address and destination,
be ready for pick-up at the agreed place and time,
behave courteously towards the Driver,
avoid soiling or damaging the vehicle; the Passenger bears cleaning or repair costs arising through their fault,
not carry dangerous, illegal, corrosive or foul-smelling items without the Driver’s consent,
comply with road traffic rules (seat belt, child seat).
The Driver may refuse to carry a person who poses a safety risk (e.g. someone visibly under the influence of alcohol or behaving aggressively), or where a required child seat is unavailable.
§ 9. Journey Cancellation and Passenger No-Shows
The Passenger may cancel a journey before it begins using the function in the App.
Scheduled journeys should be cancelled sufficiently in advance.
If the Passenger does not arrive at the pick-up point, the Driver may report this in the App after waiting 10 minutes. The Transport Operator reserves the right to introduce charges for repeated journey cancellations, no-shows or false bookings.
If the Driver does not arrive at the specified location within a reasonable time, the Passenger may cancel without penalty and book another journey.
§ 10. Items Left in the Vehicle
For items left in the vehicle, the Passenger should contact the Dispatcher (taptaxipl@gmail.com, phone 793 979
628), providing the journey’s date and time.
After the journey, the Driver may contact the Passenger only to return items left behind, handle a complaint, respond to contact initiated by the Passenger, or where required by law — through the Dispatcher wherever possible.
§ 11. Complaints
Complaints about the transport service (Driver conduct, price, vehicle condition, how the journey was carried out) and how the App works:
recipient: TapTaxi (Transport Operator),
email: taptaxipl@gmail.com,
telephone: TapTaxi dispatch centre — 793 979 628.
Reports of technical faults in the App may also be sent directly to the Technology Provider:
patrykfanslau@gmail.com.
A complaint should include: the Passenger’s first name or nickname, telephone number, journey date and time, pick-up and destination addresses (if applicable), and a description of the incident.
Complaints are handled within 14 days of receipt.
§ 12. Liability
The Transport Operator and the Driver are responsible for providing the transport service in accordance with the Transport Law Act, the Road Transport Act and the Civil Code.
FTSProjekt as the Technology Provider is responsible to the Transport Operator for the functioning of the software and is not a party to the transport contract.
The Transport Operator takes care to ensure that the App works correctly; however, it does not guarantee continuous availability — particularly in the event of outages affecting external providers (Firebase, Google Maps, Amazon Web Services, the mobile network) — and is not liable for the consequences of:
route calculation errors arising from Google Maps data,
delays caused by road conditions, weather or force majeure,
temporary unavailability of the network or external services, subject to mandatory consumer protection provisions.
§ 13. Safety
The App provides a location-sharing feature for the Driver during a journey.
In an emergency, the Passenger may ask the Driver to stop the journey, contact the Dispatcher or call the emergency services on 112.
All Drivers undergo in-person verification by the Transport Operator and regular identity verification
using a facial photograph, as required by the Road Transport Act — ensuring that the registered Driver is providing the journey.
§ 14. Personal Data (GDPR)
The controller of the personal data of the Passenger is the
Transport Operator: Taxi Kaszuby Radosław Czerniecki, ul. Szymanowskiego 2C lok. 1, 83-330 Pępowo, NIP: 8451824894, REGON: 381828420.
Contact for personal data matters:
taptaxipl@gmail.com.
Data (first name, email address, telephone number, journey history, addresses, location when booking and during journeys, chat messages, journey reviews) is processed for:
providing the App service and the journey (Article 6(1)(b) GDPR),
fulfilling legal obligations, including tax obligations (Article 6(1)(c) GDPR),
handling complaints, ensuring safety and pursuing claims (Article 6(1)(f) GDPR).
FTSProjekt processes data on behalf of the Transport Operator under a data processing agreement (Article 28 GDPR). Sub-processors are Google (Firebase, Google Maps) and Amazon Web Services — solely to the extent necessary to provide the service.
The assigned Driver receives the data necessary to provide the journey (first name, telephone number, addresses), solely for that purpose.
Retention periods: detailed location and journey data (addresses, chat) — 12 months, followed by anonymisation; settlement data — 5 years from the end of the tax year; account data — until the account is deleted.
Google and Amazon Web Services may transfer data to the USA under the EU–US Data Privacy Framework or Standard Contractual Clauses.
The Passenger has the rights of access, rectification, erasure, restriction of processing, portability, objection, and complaint to the President of the Personal Data Protection Office.
The App uses push notifications to inform the Passenger about journey status (booking acceptance, Driver arrival, messages from the Driver). The Passenger may disable notifications in their device settings.
§ 16. Final Provisions
The Transport Operator may amend these Terms and Conditions by notifying the Passenger in the App at least 7 days before the amendments take effect. Continued use of the App requires acceptance of the amendments; a Passenger who does not accept them may delete their account.
The App may require an update to the latest version. Journey booking is blocked on versions below the minimum supported version until an update is installed.
Matters not covered are governed by Polish law, in particular the Civil Code, the Transport Law Act and the GDPR.
Disputes are resolved by the court having jurisdiction under the general rules, with the rights of Passengers who are consumers preserved.
