App: TapTaxi (Android) Transport Operator and App service provider: TapTaxi — business: Taxi Kaszuby Radosław Czerniecki, ul. Szymanowskiego 2C lok. 1, 83-330 Pępowo, NIP: 8451824894, REGON: 381828420, tel.: 793 979 628 Effective date: 24.09.2026 Terms version: 1.2
§ 1. General Provisions
These Terms and Conditions govern the use of the mobile app
TapTaxi (the ‘App’) by Drivers working with the taxi company TapTaxi.
The App service provider and Transport Operator is TapTaxi — Taxi Kaszuby Radosław Czerniecki (the ‘Transport Operator’), which holds a passenger transport intermediary licence.
The Technology Provider is Taxi Osowa Patryk Fanslau (brand: FTSProjekt), ul. Gospody 18A/7, 80-340 Gdańsk, NIP: 5842626895, which supplies and maintains the App and operates the TapTaxi telephone dispatch centre on behalf of the Transport Operator. The passenger transport intermediary and the party to the cooperation agreement with the Driver is solely the Transport Operator; FTSProjekt is not the Transport Operator and does not organise a network of Drivers. Taxi Osowa Patryk Fanslau may independently provide transport as one of the cooperating Drivers, under these Terms and Conditions.
Detailed terms for working together — particularly commissions, contractual penalties, the Wallet and payouts — are set out in the Cooperation Agreement
concluded between the Driver and the Transport Operator. In the event of discrepancies, the Cooperation Agreement takes precedence.
The Driver declares that they operate a business or provide transport on behalf of a licensed carrier (Fleet Partner) and meet legal requirements, in particular those of the Road Transport Act.
Accepting these Terms and Conditions in the App is a condition of using the App as a Driver.
§ 2. Definitions
Driver — a person authorised to provide passenger transport, registered and approved as a driver in the App.
Transport Operator — the taxi company
TapTaxi, operated by Taxi Kaszuby Radosław Czerniecki (NIP: 8451824894).
Technology Provider — Taxi Osowa Patryk Fanslau (brand: FTSProjekt), which supplies and maintains the TapTaxi software and processes data solely on the Transport Operator’s instructions.
Dispatcher — a person operating the Transport Operator’s dispatch centre.
Booking Board — the list of available bookings shown to the Driver.
Immediate Journey — a booking to be fulfilled immediately after acceptance.
Scheduled Journey — a booking accepted in advance for a specified date and time.
Partner Entity — a business, hotel, other app or platform that books transport with the Transport Operator and pays it using a cashless method.
Wallet — the Driver’s balance in the App, comprising Funds (available for payout) and a
Bonus (usable solely for commissions and not available for payout).
Identity Verification — confirming with a facial photograph (selfie) that the registered Driver is providing the journey.
§ 3. Joining Requirements and Documents
Only a person who meets the following requirements may become a Driver in the App:
holds a valid category B driving licence (in accordance with the requirements of the Road Transport Act),
holds a criminal record certificate,
holds a valid passenger transport licence — for a taxi (for the municipality in which journeys are provided) or a passenger car (with a licence extract for the vehicle) — held personally or by a Fleet Partner,
holds current medical and psychological examination certificates,
has a vehicle meeting the technical requirements (valid roadworthiness inspection, third-party liability insurance),
has completed in-person verification and been approved by the Transport Operator.
In-person verification: before starting work with the Transport Operator, the Driver meets the Operator in person and brings an identity document, driving licence, driving entitlement report (available free of charge in the mObywatel app or at gov.pl) and a criminal record certificate issued no more than one month earlier. The Operator takes a photograph of the Driver’s face, which becomes the reference photograph, and digital copies of the documents.
The Transport Operator enters document and licence expiry dates in the App. The App may warn the Driver before expiry (generally 14 days in advance). Warnings are a supplementary feature — if a warning is missing or delayed (e.g. due to a technical error), the Driver is still responsible for checking that their documents remain valid.
An expired document or a missing expiry date in the system results in
an automatic account block. The account is unblocked after a current document has been sent to taptaxipl@gmail.com
and the Transport Operator has entered the new date.
The Driver must immediately inform the Transport Operator if a document is lost, suspended or revoked, and stop accepting journeys.
§ 4. Identity Verification and the Driver’s Account
Driver registration involves creating an account, completing a profile (first name, telephone number, vehicle make, registration number, vehicle category) and accepting the Terms and Conditions.
Under the Road Transport Act, the Driver must, at least once every 50 journeys and at least once every 7 days, take a selfie in the App. Until verification is complete, the Driver cannot go online or accept journeys.
The selfie is compared with the reference photograph:
automatically (Amazon Web Services Rekognition, servers in Frankfurt, EU) — solely with the Driver’s
voluntary consent ,
manually by the Dispatcher — if the Driver does not give consent, withdraws it, or the automated comparison produces a negative result.
The Driver gives or withdraws consent to automated comparison in the App (Profile). Drivers can still work with the Transport Operator if they withhold consent.
Attempted fraud (e.g. presenting a photograph instead of a live face, or having someone else complete verification) results in an immediate account block. The Transport Operator may notify the relevant authorities of the incident.
A Driver may have one account. Sharing the account with third parties is prohibited.
§ 5. Rules for Providing Journeys
The Driver accepts bookings from the Booking Board in accordance with:
the vehicle category (Standard / Estate / Minivan / Minibus),
a valid licence for the municipality of the pick-up point or destination (licences are checked separately for each municipality; a journey involving a municipality for which the licence has expired is visible but cannot be accepted),
the declared additional services (child seat, pets, courier, shopping, jump-starting).
The Driver is responsible for providing transport in accordance with the area and conditions covered by their licence.
The Driver must:
arrive on time at the Passenger’s pick-up point,
behave courteously and professionally,
take the most suitable route unless the Passenger has expressly requested another route,
start the taximeter or accept the price in the App (for bookings priced by the Dispatcher),
give the Passenger a receipt or electronic receipt for every journey.
The Driver may not refuse a journey without a valid reason. For repeated unjustified refusals, the Transport Operator may restrict access to bookings or block the account.
The Driver may refuse to carry a Passenger:
who is aggressive or poses a safety risk,
who is visibly under the influence of alcohol or drugs,
who attempts to carry dangerous, illegal or foul-smelling items,
where a child seat required by law is unavailable.
Passenger no-show: if the Passenger does not arrive at the pick-up point, the Driver reports this in the App after waiting 10 minutes. The Dispatcher reviews the report. If it is accepted, the Driver is not charged a penalty.
After the journey, the Driver sets its status in the App to
completed and confirms the price (or accepts the price set by the Dispatcher).
§ 6. Journey Price — Information for the Driver
The price shown to the Passenger before the journey is an
estimate, calculated from the planned Google Maps route and the Transport Operator’s Price List.
The final journey price may differ from the estimate, particularly where:
the journey follows a different route from the one calculated by the App,
traffic disruption occurs during the journey,
the Passenger changes the destination or adds intermediate stops,
additional services not included in the booking are added.
The Driver specifies the final price after the journey in accordance with the Price List and, at the Passenger’s request, explains how it was calculated.
For cashless journeys and bookings from Partner Entities, the Dispatcher sets the price — the Driver may not change it.
§ 7. Vehicle Categories and Additional Services
In their profile, the Driver declares their vehicle category:
Standard — Standard journeys,
Estate — Standard and Estate journeys,
Minivan — Standard, Estate and Minivan journeys,
Minibus — all journeys.
The Driver declares the additional services they provide: child seats (including the number of seats), pet transport, courier / parcel delivery, shopping, jump leads / vehicle jump-starting.
Bookings with an additional option that the Driver does not provide are visible on the Booking Board but cannot be accepted.
The Driver must accurately declare the services they provide. Deliberately false declarations may result in account suspension.
§ 8. Priority Access to Bookings
The Transport Operator may grant the Driver priority access to bookings and a lower commission rate. These benefits are available to a Driver who voluntarily displays TapTaxi branding on their vehicle (sticker, magnetic sign or vehicle wrap).
A Driver granted priority must provide journeys exclusively in the branded vehicle. Providing journeys without the branding results in an account block.
The Transport Operator sets the detailed rules for granting priority and the commission rate (the commission rate is specified in the Cooperation Agreement). Priority is not guaranteed and may change, particularly if vehicle branding is removed.
§ 9. Cashless Journeys and Partner Entities
Cashless journeys and bookings from Partner Entities (businesses, hotels, other apps) are added and priced by the Dispatcher.
The Transport Operator handles settlement with the Passenger or Partner Entity. The Driver does not collect payment for such a journey.
For cashless journeys, no commission is charged, and the entire journey amount is credited to the Driver’s Funds
immediately after the journey is completed.
§ 10. Scheduled Journeys and Alarms
A Driver who accepts a scheduled journey must provide it at the specified time.
Cancelling a scheduled journey more than 8 hours before its scheduled time is free of charge. Cancellation 8 hours or less before the journey, or failure to provide a scheduled journey, results in the penalty specified in the Cooperation Agreement.
The App assists the Driver with a push notification and an alarm approximately
20 minutes before the journey. Disabling these features or their failure does not change the Driver’s responsibility to provide the journey on time.
§ 11. Wallet, Commissions and Payouts
The Wallet operates on a prepaid basis. The Driver adds Funds in the App (e.g. through PayU).
Commission on cash journeys is deducted automatically after the journey at the individual rate specified in the Cooperation Agreement — first from the Bonus, then from Funds for the remainder. A cash journey can be accepted if the Bonus and positive Funds cover the commission on the estimated price.
Bonus: a new account receives an initial Bonus of PLN 50. Every Bonus (initial and subsequent) can be used solely to cover commission; it cannot cover penalties and is not available for payout or refund.
Contractual penalties (including for cancelling or failing to provide a journey) are deducted automatically from Funds, not from the Bonus. Before a journey is cancelled, the App informs the Driver of the penalty amount.
Negative Funds: where Funds fall below −PLN 100 , the Driver cannot go online or accept journeys from the Booking Board until the balance is topped up. The Bonus does not reduce the debt.
Payouts: the Driver submits a request in the App for Funds (excluding the Bonus) to be paid out by transfer to the account specified in the Cooperation Agreement. The first payout in a calendar week is free; each subsequent payout costs PLN 5. Details are set out in the Cooperation Agreement.
FTSProjekt is not a party to settlements between the Driver, the Transport Operator and the Passenger.
§ 12. Driver Obligations
The Driver undertakes to:
Keep the vehicle clean inside and out and in full working order.
Refrain from smoking tobacco products in a vehicle used for journeys and from using e-cigarettes during a journey and in the Passenger’s presence.
Carry and present on request: a driving licence, vehicle registration certificate, third-party liability insurance policy and transport licence.
Follow road traffic rules and drive safely (use a phone only in a holder or use voice navigation).
Enter the final journey price accurately.
Refrain from driving under the influence of alcohol, drugs or medication that impairs driving ability.
Use the current version of the App.
Complete identity verification on time.
Maintain the confidentiality of Passenger data. After a journey, the Driver must not contact the Passenger except to return items left behind, handle a complaint, respond to contact initiated by the Passenger, or where required by law. Contact through the Dispatcher is recommended even in these cases. Under no circumstances may the Driver arrange journeys outside the App.
§ 13. Prohibited Conduct
In particular, the Driver is prohibited from:
Providing journeys without a valid licence or other required documents.
Using another person’s account or sharing their own account.
Manipulating GPS location (including using location-spoofing apps). The App records the detection of a false location and reports it to the Transport Operator.
Entering false final prices, overcharging for journeys or charging fees contrary to the Price List.
Encouraging a Passenger to cancel a booking and take the journey outside the App (‘off-app’).
Habitually refusing short or low-profit journeys.
Verbal or physical aggression towards Passengers, other Drivers or Dispatchers.
Photographing or recording Passengers without their consent, except where permitted by law.
§ 14. Safety and the SOS Feature
The App provides an SOS feature enabling the Driver to alert the Dispatcher and other nearby Drivers in a dangerous situation.
The SOS feature must only be used in genuine emergencies.
In a serious emergency, the Driver must first notify the emergency services (112).
§ 15. Account Blocking, Suspension and Appeals
The account is blocked automatically when a document expires or has no expiry date recorded, identity verification is overdue, or Funds fall below −PLN 100. The block ends when the cause is remedied.
The Transport Operator may temporarily suspend or
permanently block an account for breach of these Terms and Conditions or the Cooperation Agreement, substantiated Passenger complaints, attempted fraud or conduct endangering Passenger safety.
The Driver is informed of the block and the reasons for it and may appeal within 14 days.
§ 16. Liability
Transport Operator is responsible for the terms of its working relationship with the Driver, verification, booking allocation, settlements and disciplinary matters.
FTSProjekt as the Technology Provider is responsible to the Transport Operator for the functioning of the software and is not a party to the agreement with the Driver.
The Transport Operator and FTSProjekt take care to ensure that the App works correctly; however, they do not guarantee continuous availability — particularly during outages affecting external providers (Firebase, Google Maps, Amazon Web Services, the mobile network). They are not liable for missed journeys caused by those services being unavailable, disabled notifications or errors in supplementary features (warnings, alarms, reminders).
§ 17. Personal Data (GDPR)
The controller of the personal data of the Driver is the
Transport Operator: Taxi Kaszuby Radosław Czerniecki, ul. Szymanowskiego 2C lok. 1, 83-330 Pępowo. Contact:
taptaxipl@gmail.com.
FTSProjekt processes data on behalf of the Transport Operator under a data processing agreement (Article 28 GDPR), solely to supply and maintain the App. Sub-processors are Google (Firebase, Google Maps; servers in the EU) and Amazon Web Services (facial comparison — solely with consent; servers in Frankfurt, EU).
Data categories: first name and surname, business details (name, address, NIP), telephone number, email address, vehicle details, licence details, document copies, reference and verification photographs, location while online and during journeys, journey history, Wallet, payout account and reports of false locations.
Legal bases for processing: performance of a contract (Article 6(1)(b) GDPR); legal obligations, including identity verification and the booking register and records required under the Road Transport Act (Article 6(1)(c) GDPR); protection against abuse and pursuing claims (Article 6(1)(f) GDPR); automated facial comparison — consent (Article 9(2)(a) GDPR).
Retention periods: booking register, records, verification photographs and document copies — 5 years (under the Road Transport Act); settlement data — 5 years from the end of the tax year; detailed location and journey data — 12 months, followed by anonymisation.
The Driver has the rights of access, rectification, erasure (subject to retention obligations), restriction, portability, objection, withdrawal of consent and complaint to the President of the Personal Data Protection Office. Details are set out in the information notice accompanying the Cooperation Agreement.
§ 18. Push Notifications
The App sends notifications about new bookings, pre-journey alarms for scheduled journeys, messages from the Passenger and Dispatcher, verification and payout results, and system messages.
Disabling notifications may mean missing important bookings. The Transport Operator is not liable for journeys missed for this reason.
§ 19. App Updates and Availability
The Driver must use the latest version of the App. Versions below the minimum supported version are blocked, with a message requiring an update.
The Transport Operator reserves the right to interrupt service for maintenance and change how the App works.
Reports of technical faults in the App may also be sent directly to the Technology Provider:
patrykfanslau@gmail.com.
Complaints are handled within 14 days of receipt.
§ 21. Final Provisions
The Transport Operator may amend these Terms and Conditions with 7 days’ notice, notifying the Driver in the App or electronically. Continued use of the App requires acceptance of the amendments; a Driver who does not accept them may terminate the Cooperation Agreement.
Matters not covered are governed by Polish law, in particular the Civil Code, the Transport Law Act, the Road Transport Act and the GDPR.
Disputes are resolved by the court with jurisdiction over the Transport Operator’s registered office.
